Trade Practices Advisory Services

MSI assists Domestic Industry to access the WTO trade remedy instruments in both making use of the trade remedy instruments, where it merits, and assists in defending the domestic industry against trade remedy actions by foreign countries.

Types of Services Offered by MSI

  • Trade Remedy – Application
    ✓ Evaluation of appropriate form of trade remedy;
    ✓ Assist in preparation of the application for trade remedy; and
    ✓ Reviews of Trade Remedies:
         - Administrative review; and
         - Sunset review.
  • Trade Remedy Cases Against Malaysian Companies including anti-circumvention:
    ✓ Provide guidance on response to questionnaire.
  • Malaysia/ASEAN FTAs (Trade in Goods):
    ✓ Rules of Origin; and
    ✓ Tariffs
  • Training on WTO Trade Remedies including anti-circumvention;
    ✓ Introductory level;
    ✓ Intermediate level;
    ✓ Advance Level; and
    ✓ Tailor made on specific areas of interest.

Trade Remedies

MSI assists domestic industry by:

  • raising awareness of how the trade remedy system works;
  • giving advice on anti-dumping, countervailing and safeguards matters, including options for businesses to participate in the trade remedy system;
  • helping to decide on an appropriate form of trade remedy;
  • advising on the requirements involved in an application;
  • assisting with preparing applications for: anti-dumping or countervailing or safeguards investigations including reviews; and
  • facilitating industry players to make an application.

What MSI does not do?

MSI provides advisory services and provides assistance service only and does not act as a consultant, agent or advocate for the domestic industry/association making a trade remedy request.

MSI's involvement ends once an application has been formally submitted and MSI does not guarantee that an investigation will be initiated or a positive decision will be made.

MSI will not make representations to or meet with the Investigating Authority of the Ministry of International Trade and Industry (MITI) at any time related to investigation.

The industry/association must maintain ownership of and responsibility for their involvement in the trade remedy request and must lead the preparation of those documents.

MSI will not involve itself with appeals of decisions resulting from the Investigating Authority’s investigations.

 

MSI and the Investigating Authority at MITI

The Trade Remedy Investigating Authority at MITI generally conducts trade remedy investigations based on petition submitted by or on behalf of the industry and makes recommendations to the Minister of Finance regarding the imposition of anti-dumping duties/countervailing duties/safeguards duties.

The Government may however on its own too can initiate a trade remedy investigation, without a petition submission by the industry.

MSI operates independently of the Investigating Authority and vice-versa on matters related trade remedy investigations.

Assistance given in petition preparation by MSI to the industry does not bind the Investigating Authority, or guarantee that the Investigating Authority will act in a particular way or make certain findings.
